The Fine Print
Marketing services businesses, CreativeXchange Marketing, llc., Phases Design Studio, inc. and The Write Stuff are offering an Online Contest - Denver's Making the Brand™ 2009 ("Contest")
and are the "Contest Presenters" and "Judges". Other businesses will be contributing through some form of in-kind donation and are "Contest Sponsors".
OFFICIAL CONTEST RULES
Eligibility:
- Business must be in the contest boundaries of the 7 county Denver Metro area (Adams, Arapahoe, Broomfield, Boulder, Denver, Douglas and Jefferson Counties of Colorado).
- Business must have fewer than 100 employees, none of which fill any kind of marketing position (example: graphic designer, copywriter, media buyer, marketing manager/director, etc).
- Business must be privately owned and operated.
- Business cannot be a franchise or Licensee.
- The business or DBA entity requesting to be entered into the contest to receive the branding price package must have been in business and on record with the Colorado Secretary of State since January 1, 2008 and must be up to date with their registration with the Colorado Secretary of State. Business or DBA entering must supply their Colorado Secretary of State business ID#.
- Business will have an obvious need and realize the need to strengthen their current brand.
- Employees, subcontractors, vendors, current clients or immediate family members of the Contest Presenters, Contest Sponsors and Judges are not eligible to win.
- Businesses that are under contract discussions with any open bids or estimates with the Contest Presenters and/or Contest Sponsors for services listed in the prizes are not eligible to win.
- All nominations must be submitted online by midnight, February 14, 2009. For online nominations to be eligible, the owner of the business being nominated must accept the nomination via an email confirmation that will be sent to their individual email accounts. By accepting the nomination, contest participants agree to the Official Contest Rules. Acceptance of the nomination must be received no later than midnight, February 15, 2009. Participants of the contest agree that Contest Presenters and Contest Sponsors are not responsible for lost or spam filtered nomination forms or acceptance notification email communications. Correct and active email accounts must be provided on the nomination form by person nominating a business or business nominating oneself. Nominator and Business Owner agrees to have their email address added to Contest Presenters and Contest Sponsors databases for future contest notifications and promotions, unless they decide to opt out.
How to Enter/Deadlines:
- No purchase necessary to win. Purchasing products or services from any of the Contest Presenters and Contest Sponsors does not improve odds of winning.
- Anyone can nominate a business - nominating one's own business is acceptable. If someone other than the business owner is nominating a business, the nominator agrees that their name will be released
as the "nominator".
- Simply fill out and submit an online nomination form at: www.denversmakingthebrand.com.
- Nominations must be received by midnight, January 31, 2009. Contest Presenters and Contest Sponsors are not responsible for lost, misdirected, undeliverable or spam filtered nomination forms
or acceptance emails. Providing proper email addresses of the nominator and business being nominated is the sole responsibility of the nominator and/or business nominating oneself. Contest Presenters
and Contest Sponsors will not be responsible for informing the nominator or business being nominated of acceptance emails not received. Entries become the sole property of the Contest Presenters
and will not be returned.

Winner Selection:
- Late and/or incomplete nomination forms will be disqualified.
- Nine Semi-Finalists will be selected from the pool of eligible nomination forms for a phone interview. From those nine Semi-Finalists, three Finalists will be selected for an in-person interview to determine the Grand Prize Winner. If one of the Finalists withdraws or is deemed ineligible during the interview process, the next qualified nominee will be selected for interviewing.
- Judges will be looking for the top three promising businesses that have an obvious need for re-branding and meet all eligibility requirements.
- Finalists must agree to have their name, likeness, photo, business and case study promoted in any way the Contest Presenters see fit (including, but not limited to website, press releases, promotional
flyers, ads, videos, etc.) Finalists must complete and sign a release form.
- Finalists must agree that if chosen as the winner, they will use and maintain the new branding to be provided upon completion of the project in accordance to the brand standards provided by the Contest.
- Finalists agree that if chosen as the winner, they will allow for a "Proud winner of the Denver's Making the Brand™ 2009" contest logo and link on their website homepage to the Contest
website for one year.
- Finalists must agree to all eligibility requirements, terms and rules of this contest.
- Finalists must agree that if chosen as the winner, they will adhere to the Contest Presenter's project timelines to be established for a completion and unveiling event no later than Fall of
2009. Project tasks and milestone completion dates will be determined by the Contest Presenters. Any missed deadlines by the winner may result in forfeiture of any portion of the Grand Prize associated with the missed timeline milestone.
- Finalists agree to meet for a one hour in-person interview with judges between February
16 and March 2, 2009. Winner will be notified no later than March 16, 2009 and their information
will be released to the media no later than March 31, 2009.
- Decisions of the Judges/Contest Presenters are final.
Grand Prize:
- Only one Grand Prize Winner will be awarded stated prizes.
- Grand Prize includes:
- Target market review
- Competitor brand review
- Any needed marketing research
- SWOT analysis (Strengths, Weaknesses, Opportunities and Threats of your business)
- Marketing Plan
- Name recommendations if needed
- New logo - 2 concepts provided
- Logo Usage Guidelines
- Design and copywriting of any marketing collateral deemed necessary by Contest Presenters and within the contest budget.
- New website - up to a 5 page static website. Design, copywriting, code development and Search Engine Optimization (SEO). Flash and Content Management not provided. If winner does not currently
have website hosting, basic hosting and domain registration will be provided for one year. SEO disclaimer: Winning finalists may not quality for the SEO portion of the package due to exclusivity
agreements with SEO Sponsor's current clients. Any and all finalists falling within
this restriction will be informed during the final selection process. Exclusivity conflicts do not constitute valid reason to opt out of the Making the Brand™ contest final prize. In
the event there is an exclusivity conflict and SEO prize cannot be awarded, there will be no substitution for this prize.
- If needed as determined by Judges, winner will also receive up to 4 hour of product/marketing photography for use in marketing collaterals and website.
- If needed as determined by Judges, winner will also receive a 30 second video commercial that can be used on Grand Prize Winner's website or if deemed appropriate a 30 second TV Commercial.
- New tagline - 3 concepts provided
- 30 second USP (Unique Sales Proposition)
- Printing of any marketing collaterals deemed necessary by Contest Presenters and within the contest budget.
- If appropriate for the winning business, up to a year of free billboard advertising with a cap of $5,000. Includes layout, design and printing.
- Screen printed garments
GRAND PRIZE TOTAL APPROXIMATE VALUE of Branding Prize Package $25,000
Value is approximate. Value based on winner's marketing needs as determined by judges. Winner is responsible for any portions of the prize which may be taxable.
Odds of winning
Odds of winning depend on the number of eligible entries received.
Use of Contest Information:
Nominated Business grants to Contest Presenters, and Contest Presenters reserves the right to use any and all information related to the Contest, including information provided by Nominator and
Nominated Business in connection with the Contest, for marketing purposes or any other purpose, unless prohibited by law. Finalists will be required to sign a release, which grants the Contest
Presenters the right to use and publish their proper name, and business name online or in any other media in connection with the Contest. Before accepting a prize, Finalists will be required to
sign a release that grants permission to Contest Presenters to use his or her name, photograph, likeness, voice, prize information and/or business information for publicity and promotional purposes
without future compensation unless prohibited by law. Finalists must also agree to sign a release to grant copyright of all information, photos, quotes, all branding materials including, but not
limited to logo, website, collaterals, stationary, business cards and any other tangible form of creative work produced as a result of winning the contest. Contest Presenters will grant perpetual
use rights of all prizes to Grand Prize Winner. By entering, participants release and hold harmless Contest Presenters, their respective parents, subsidiaries, affiliates, directors, officers,
employees, other Contest Sponsors and agents from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Contest or any prize won. Restrictions,
conditions and limitations apply. Nominated Businesses and Nominators may opt-out of the Contest Presenters and Contest Sponsor's email database by de-selecting the agreement to receive email communication
from Contest Presenters and Contest Sponsors on the online nomination and nomination acceptance forms.
CONDUCT:
By entering the Contest, you agree to be bound by these Official Contest Rules. The Official Contest Rules will be posted on www.denversmakingthebrand.com throughout the Contest. Nominated Businesses
and Nominators further agree to be bound by the decisions of the Contest Presenters, which shall be final and binding in all respects. Contest Presenters reserves the right at their sole discretion
to disqualify any individual they find to be tampering with the entry process or to be acting in violation of the Official Contest Rules.
LIMITATIONS OF LIABILITY:
Winners assume liability for losses or injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize. Contest
Presenters are not responsible: (i) for any lost, late, undeliverable, incomplete, spam-filtered, or misdirected email; or (ii) for any incorrect or inaccurate information, in the Contest or by
any technical or human error that may occur in the processing of submissions in the Contest. Contest Presenters assumes no responsibility for an error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft or destruction of authorized access to, or alteration of, entries. Contest Presenters are not responsible for any problems
or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems
or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating
or downloading materials in the Contest. If the Contest is not capable of running as planned for any reason, including legal restrictions, tampering, unauthorized intervention, fraud, technical
failures, or any other causes beyond the control of Contest Presenters that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Contest Presenters
reserves the right to cancel, terminate, modify or suspend the Contest.

INTERNET:
If for any reason, the Internet-related portion of the Contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause
which corrupts or threatens the administration, security or integrity of the Contest, the Contest Presenters reserves the right, in its sole discretion, to terminate or suspend the Contest or any
portion of the Contest. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS CONTEST WILL RESULT IN DISQUALIFICATION FROM THE CONTEST. Information submitted in Internet
entries, including the entrant's name, e-mail address, etc., shall become the property of the Contest Presenters, and may be used by Contest Presenters for marketing or promotional purposes, unless
opted-out on online nomination form and nomination acceptance form.
GENERAL CONDITIONS:
This Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law. Winner is responsible for any portions of the prize which may be taxable.
GENERAL RELEASE:
By entering the Contest, Nominated Businesses and Nominators release Contest Presenters, any other Contest Sponsors, and each of their respective parents, affiliated companies, directors, officers,
employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the
acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property,
rights of publicity or privacy, defamation, or portrayal in a false light). "Denver 's Making the Brand™" contest is made available through the Contest Presenters: CreativeXchange Marketing,
llc, Phases Design Studio, inc. and The Write Stuff, whose decisions regarding the selection of Winners and all other aspects of Contest shall be final and binding in all respects. Contest Presenters
will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other Contest materials. If you have any questions regarding this Contest,
